Article 1 - Scope

These Terms and Conditions of Sale apply without restriction or reserve to all sales concluded by Mama Found It (Mama Hangs), hereinafter referred to as "the Seller," with consumers and non-professional buyers, hereinafter referred to as "the Customer" or "the Customers," wishing to acquire the products offered for sale by the Seller ("the Products") on its website: https://www.mama-hangs.com.

They specify, in particular, the conditions of ordering, payment, delivery, and management of any returns of Products ordered by the Customers.

These Terms and Conditions of Sale may be supplemented by specific conditions stated on the website before any transaction with the Customer.

These Terms and Conditions of Sale apply to the exclusion of all other conditions, notably those applicable to in-store sales or other distribution and marketing channels.

Amendments to these Terms and Conditions of Sale are applicable to users of the site from the moment they are published online and cannot apply to transactions concluded prior to their publication.

Unless proven otherwise, the data recorded by the Seller constitutes proof of all transactions. Product offers are subject to stock availability. Availability indications are provided on the product sheet.

Customer's validation of the order implies unconditional acceptance of these Terms and Conditions of Sale.

Article 2 - Products Offered for Sale

The main characteristics of the Products, including specifications, illustrations, and dimensions or capacities, are presented on the website www.mama-hangs.com.

The Customer is required to review these details before placing an order. The choice and purchase of a Product are solely the Customer’s responsibility.

The photographs and graphics presented on the website are non-contractual and cannot engage the Seller's liability. The Customer acknowledges that the photographs representing the Products on the website are for indicative purposes only. Alterations may occur due to photo processing.

The Customer should refer to the description of each Product to understand its properties, essential features, delivery times, and, in the case of continuous or periodic supply of a good, the minimum duration of the proposed contract.

Contractual information is presented in English and is confirmed at the latest at the time of the Customer’s order validation.

Article 4 - Placing an Order

The sale is reserved for Customers who are of legal age or minors with parental authorization.

The Customer must select the Products they wish to order on the website www.mama-hangs.com according to the following steps:

1. The Customer selects the products they wish to order on the site.
2. After choosing the Product(s), the Customer confirms the contents of their cart and proceeds to validate the order.
3. The Customer must provide the billing address, which will be considered as the delivery address unless otherwise instructed.
4. The Customer can then validate their order via a secure payment by credit card or PayPal.
5. The Customer has the option to check the details of their order, the total price, and correct any possible errors before confirming their acceptance. It is the Customer's responsibility to verify the accuracy of the order and immediately report or correct any errors.

The order is recorded on the website www.mama-hangs.com when the Customer accepts these Terms and Conditions of Sale by checking the box provided and validates their order. This validation implies acceptance of all these Terms and Conditions of Sale as well as the general terms of use of the website www.mama-hangs.com.

The sale is only final after the Seller has sent the Customer confirmation of acceptance of the order by email, which is sent after receipt of the full payment.

Any order placed, validated by the Customer, and confirmed by the Seller under the conditions described above on the website www.mama-hangs.com constitutes the formation of a distance contract between the Customer and the Seller.

Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer.

The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute concerning the payment of a previous order.

Article 5 - Pricing and Validity Conditions

Prices are indicated in euros.

The prices listed on the website www.mama-hangs.com
are all-inclusive prices in euros for users from European Union countries within the Schengen area, taking into account any discounts and the VAT applicable on the day of the order; any change in the rate may be reflected in the product price.

are shown excluding VAT for users from all countries outside the European Union.

Prices are guaranteed within the limit of available stocks.

The Seller reserves the right to modify its prices at any time, with the understanding that the price listed on the site on the day of the order will be the only applicable price to the Customer, except in cases of typographical or omission errors.

Prices do not include delivery charges, which will be billed in addition and will be specified to the Customer at the time of final order validation.

If the Customer requests a faster or more expensive shipping method than standard shipping, the additional delivery costs, as they appear at the time of order validation, are entirely at the Customer’s expense.

An invoice is issued by the Seller and is accessible by the Customer on their online account, provided that the Customer has created one. The Customer can request a duplicate of their invoice from the Seller at any time by sending an email to heymama@mama-hangs.com.

Any order destined for a country outside the European Union is delivered under the CIP (Carriage and Insurance Paid To) Incoterm and may be subject to customs fees and VAT payment in the concerned country. Mama Found It cannot be held responsible for these additional costs incurred by the buyer.

Article 6 - Payment Conditions

The price is payable in full on the day of the order placement by the Customer via secure payment methods. The Seller will not be obligated to deliver the ordered products if the Customer does not pay the full price under the conditions specified above.

Payments made by the Customer will only be considered final after the Seller has effectively received the funds. Furthermore, the Seller reserves the right to suspend or cancel the delivery of ongoing orders if the payment conditions are not met.

Article 7 - Delivery and Shipping

The Products ordered by the Customer will be delivered in mainland France and abroad within thirty (30) days from the validation of the order to the address provided by the Customer during the order on the website www.mama-hangs.com.

The Customer will be informed of the delivery status of their order by email, including any tracking number.

Delivery times are given as an indication only and may vary depending on the availability of the Products and the chosen shipping method.

In case of late delivery, the Customer should contact the Seller’s customer service at heymama@mama-hangs.com. The Seller will inform the Customer of the estimated new delivery date.

The Seller cannot be held responsible for any delay in delivery caused by the transport service or force majeure.

Article 8 - Right of Withdrawal and Returns

In accordance with legal provisions, the Customer has a period of fourteen (14) days from the receipt of the Products to exercise their right of withdrawal without having to justify reasons or pay penalties, except for the cost of return shipping.

To exercise the right of withdrawal, the Customer must notify the Seller of their decision to withdraw by contacting the customer service at heymama@mama-hangs.com. The Customer can use the withdrawal form available on the website, but it is not mandatory.

The Customer must return the Products in their original packaging and condition to the Seller within fourteen (14) days from notifying the withdrawal decision.

The Seller will refund the Customer for the amount paid for the Products, excluding return shipping costs, within fourteen (14) days from the receipt of the returned Products. The Seller may delay the refund until the Products are received or proof of their return is provided.

The right of withdrawal cannot be exercised for Products that have been used, damaged, or personalized according to the Customer's specifications.

Article 9 - Warranty and Liability

The Seller guarantees that the Products are free from defects and conform to the contract. In the event of a defect or non-conformity, the Customer must notify the Seller within two (2) months from the discovery of the defect.

The Seller is not liable for any damage resulting from improper use or handling of the Products by the Customer or any third party.

The Seller’s liability is limited to the amount of the order and excludes any indirect damages or consequential losses suffered by the Customer.

Article 10 - Personal Data

The Seller collects and processes personal data of the Customer in accordance with applicable data protection regulations. The Seller’s privacy policy, available on the website, explains how personal data is collected, used, and protected.

The Customer has the right to access, rectify, and delete their personal data. They can exercise these rights by contacting the Seller’s customer service at heymama@mama-hangs.com.

Article 11 - Governing Law and Jurisdiction

These Terms and Conditions of Sale are governed by French law. Any disputes arising from the interpretation or execution of these Terms and Conditions of Sale shall be submitted to the competent French courts.
